    That Council declare surplus to municipal need and dispose of the property known municipally as 196 Lappan’s Lane, being legally described as Part of Part Lot 22, Concession 3, Part 1, Plan 13R-10408 in the City of Kingston, County of Frontenac, being all of PIN 36063-0035; and

    That the Mayor and Clerk be authorized to execute all necessary agreements and other documents as may be required to transfer Part of Part Lot 22, Concession 3, Part 1, Plan 13R-10408 in the City of Kingston, County of Frontenac, being all of PIN 36063-0035 for $4,100,000, in a form satisfactory to the Director of Legal Services; and

    That Council waive the requirement for staff to obtain two independent appraisals from certified appraisers when the property value is over $1,000,000, in accordance with the City’s Disposition of Real Property Policy; and

    That the net proceeds from the sale of the property be used to support the development of the relocated household hazardous waste site and the remaining be transferred to the Municipal Capital Reserve Fund.

    That Council declare pursuant to Ont. Reg 603/06 s. 6(1) under Section 110 of the Municipal Act, 2001 that the municipal capital facilities are for the purposes of the municipality and are for public use; and

    That the Director, Business, Real Estate & Environment, be delegated the authority to approve a lease agreement with Limestone Animation Inc. for space at 623 King Street West that embed the following benefits: rent-free, tax exemption, funds for facility operations and allocation of staff time, with said authority to be added to By-Law Number 2025-157, Delegation of Authority By-Law, as part of future amendments; and

    That Council approve a Municipal Capital Facility Agreement between Limestone Animation Inc and The Corporation of the City of Kingston for 623 King Street West in order to exempt the premises from taxation for municipal and education purposes, effective upon the execution of the Municipal Capital Facility Agreement; and

    That in accordance with Section 110(6) of the Municipal Act, 2001, the By-Law attached as Exhibit B to Report Number 25-197, be presented and given all three readings to provide an exemption to all of 623 King Street West, from taxation for municipal and school purposes, following the approval and execution of the associated lease; and

    That in accordance with Section 110(8) of the Municipal Act, 2001 the Clerk be directed to give written notice of the passing of the By-Law to the local school boards having jurisdiction in the area in which the property is located and to the Municipal Property Assessment Corporation as required by Section 110(5) and (8).

    That a By-Law be presented for all three readings to amend By-Law Number 2010-128, A By-Law to Regulate Parking, as amended, as per Exhibit A to Report Number 25-175 to apply the proposed parking regulations; and

    That Council approve a set fine of $35.00 and early payment amount of $30.00 for a new parking violation section for the already existing no parking between 12 a.m. and 7 a.m. regulation, in effect each night during January and February, and during Declared Weather Events in December and March, on streets around Kingston General Hospital, including Stuart  St., George St., and O’Kill St., and direct staff to seek approval from the Ministry of the Attorney General for said fine amounts.

    That upon execution of the MOU by all parties, Council approve the allocation of up to $300,000 from the Working Fund Reserve to initiate the development of a comprehensive district master plan for the Life and Health Sciences Innovation District.

    That Council adopt the following blanket municipal support resolution for future Long-Term Energy Supply Projects and Long-Term Capacity Services Projects proposed within the City, it being understood that the support resolution does not apply to natural gas generated projects and exclusively applies to projects that include solar, electricity storage and biofuels within the City of Kingston:

    Whereas the Independent Energy System Operator’s (IESO) Long-Term 2 (LT2) program encourages the construction and operation of energy supply and energy storage projects; and

    Whereas one or more energy supply or energy storage projects may be constructed and operated within the City of Kingston; and

    Whereas pursuant to the LT2 Energy Supply Request for Proposals and the LT2 Capacity Services Request for Proposals, issued on June 27, 2025, Proposals must submit a Municipal Support Confirmation;

    Therefore Be It Resolved That Kingston City Council offers blanket support for the development, construction and operation of Long-Term Energy Supply Projects and Long-Term Capacity Services Projects, under the LT2 program, within the City of Kingston; and

    That the Chief Administrative Officer is delegated the authority to issue a “Blanket Municipal Support Confirmation Letter” for proponents who seek to establish a Long-Term Energy Supply or a Long-Term Capacity Service project within the City of Kingston; and

    That this resolution of municipal support does not supersede any applicable permits or approvals under applicable Laws and Regulations that may be required for a particular Long-Term Energy Supply or Capacity Services project. This resolution shall expire twelve (12) months after its adoption by Council.

    That Council approve a budget amendment of $12,000,000, to be funded from the Municipal Capital Reserve Fund, to advance the investment in road renewal and rehabilitation work ahead of the 2026 capital budget process; and

    That Council approve a budget amendment of $325,000 to enable access to grant funding for the installation of the solar photovoltaic (PV) system at Rideau Heights Community Centre, funded from the Municipal Environmental Reserve Fund; and

    That Council approve a budget amendment of $125,000, with $50,000 funded from the Municipal Capital Reserve Fund and the remainder from the Development Charges Reserve Fund, to fund additional costs related to the 2024 Development Charges By-Law process; and

    That Council approve a budget amendment of $1,300,000, to be funded from the proceeds of sale of the Kingston Area Recycling Centre property, to fund the relocation of the Household Hazardous Waste site; and

    That Council approve a budget amendment of $1,000,000, funded from the Municipal Capital Reserve Fund, to support the purchase and implementation of a new point-of-sale system; and

    That Council approve a budget amendment of $3,500,000 for housing related initiatives, with funding from the proceeds of sale of the 900 Division Street property ($1,500,000 less closing costs) with the remaining balance to be funded from the Municipal Capital Reserve Fund; and

    That Council approve the closure of the Kingston Frontenac Public Library’s Steele Reserve Fund.

    That Council provide a notice of intention to withdraw from the Kingston and Area Taxi Licensing Commission to the Province of Ontario, Loyalist Township and the Kingston and Area Taxi Licensing Commission; and

    That Council direct staff to initiate all required processes to implement a transition of taxi oversight services from the Kingston and Area Taxi Licensing Commission to the City of Kingston to be effective by September 2026; and

    That Council direct staff to work in partnership with Loyalist Township in the development of a new municipal oversight framework that ensures the continuation of effective taxi services for both the City of Kingston and Loyalist Township.

    That Council, in accordance with Section 296(1) and (3) of the Municipal Act, 2001, as amended, authorize the appointment of KPMG LLP as auditor of The Corporation of the City of Kingston and Kingston-Frontenac Public Library for a period of three years (2025-2027), with the option of extending the appointment for two additional years (2028-2029); and

    That Council delegates authority to the Chief Financial Officer and City Treasurer, at their discretion, to extend the appointment of KPMG LLP as auditor of The Corporation of the City of Kingston and its local boards by exercising the option of appointment for two additional years for the period January 1, 2028 to December 31, 2029; and

    That Council delegate authority to the Chief Financial Officer and City Treasurer to sign audit engagement letters with KPMG LLP, in a form satisfactory to the City Solicitor, to engage KPMG LLP to conduct audits on behalf of the City of Kingston and its local boards for the period January 1, 2025 to December 31, 2027, as well as any extensions of appointment; and

    That a draft By-Law, attached as Exhibit A to Report Number AP-25-016, be presented for all three readings to appoint KPMG LLP as auditor for the City of Kingston and its local boards for a period of three years (2025-2027), with the option of appointing for two additional years (2028-2029).

    Whereas Highway 2 East runs across a provincially significant wetland complex between Abbey Dawn Road and St. Lawrence Avenue with a speed limit of 80km/hour; and

    Whereas the wetland complex is only a short section of Highway 2 East, less than 1 kilometre long, but a speed limit reduction is not warranted based on the engineering standards from the Transportation Association of Canada that City staff follow; and

    Whereas the engineering standards from the Transportation Association of Canada do not give consideration to the protection of turtles or other wildlife when warranting speed limit reductions; and

    Whereas the City of Kingston has just invested in enhanced flood protection along Abbey Dawn Road, Highway 2 and St. Lawrence Avenue that included the installation of turtle fencing along many parts of the wetland, however, there are still at least 9 access roads and a private road where turtles have easy access to get onto Highway 2 East in that short stretch; and

    Whereas turtles are a keystone species, their populations are in critical decline, they need protection from human interference, and Council’s 2023-2026 Strategic Plan includes a commitment to protecting the biodiversity in the city;

    Therefore Be It Resolved That Council direct staff to lower the speed limit to 60km/hour on Highway 2 East from Abbey Dawn Road to St. Lawrence Ave, extend the no passing zone on Highway 2 East from its current eastern limit at 48 metres east of Abbey Dawn Road a further 506 metres easterly to St. Lawrence Avenue, and post “Do Not Pass” signs at the ends of the wetland; and

    That Council direct staff to put funds in the 2026 budget to convert the Turtle Warning signs at each end of the wetland to be yellow flashing signs for the 2026 season; and

    That Council direct staff to bring a report to Council by the end of Q1 2026 with recommended amendments to the appropriate City by-law(s) to establish a prohibition of fishing on or from City property at turtle habitat areas, where indicated by signage.

    Whereas heritage is a fundamental part of individual and community identity, and is a major driver of Kingston’s tourism economy; and

    Whereas the Ontario Heritage Act encourages municipalities in Ontario to designate and protect properties that meet provincial criteria related to design value, associative value and contextual value; and

    Whereas the Provincial Planning Statement states that protected heritage property shall be conserved; and

    Whereas the City of Kingston’s Official Plan states that built heritage resources in Kingston shall be conserved; and

    Whereas conserving heritage properties has direct benefits to property values, tourism and the environment; and

    Whereas homeowners require insurance to protect their homes, which is often their most significant financial investment, and can be required to maintain a mortgage; and

    Whereas the cost of living and the cost of insurance is on the rise in Canada; and

    Whereas the Province of Ontario has stated that a heritage designation does not place additional requirements on insurers and that insurance premiums should not go up because of a heritage designation; and

    Whereas some homeowners have reported that their premiums have gone up as a result of a heritage designation or they have been denied an insurance policy as a result of a heritage designation; and

    Whereas, as a result of insurance concerns, some impacted homeowners have objected to a proposed heritage designation on their property or have applied to have a designating by-law repealed; and

    Whereas this directly threatens the unique and irreplaceable heritage character of Kingston and Ontario;

    Therefore Be It Resolved That Kingston City Council call on the Provincial Government to:

    • investigate why some insurers are raising premiums on heritage designated properties or are denying insurance policies as a result of a heritage designation in contravention of provincial guidance; and
    • bring insurance regulators, insurance industry representatives and heritage professionals together to find solutions that enable the continued protection of heritage properties without unwarranted financial burden on homeowners; and
    • regulate the impact of heritage designation on insurance premiums through enforcement, education and new solutions;

    That a copy of this resolution be forwarded to the Honourable Doug Ford, M.P.P. Premier of Ontario, the Honourable Graham McGregor, M.P.P. Minister of Citizenship and Multiculturalism, Ted Hsu, M.P.P. Kingston and the Islands and John Jordan, M.P.P. Lanark-Frontenac-Kingston, all Ontario municipalities, the Association of Municipalities of Ontario, the Financial Services Regulatory Authority of Ontario, the Canadian Council of Insurance Regulators, and the Insurance Bureau of Canada.

    Whereas vulnerable populations, including people experiencing homelessness, many renters, those with medical conditions and those who are precariously housed, are particularly vulnerable to hot weather; and

    Whereas hot weather can worsen mental health issues, aggravate preexisting conditions such as heart disease and chronic respiratory diseases, and cause a range of impacts from cramps, rashes, delirium, heat exhaustion and stroke to, in extreme cases, death; and

    Whereas according to Report Number EITP-25-011 from the Environment, Infrastructure & Transportation Policies Committee, the number of very hot days (+30˚C) in Kingston is expected to increase from an average of 6 days per year to an average of 22 days per year by 2050, and the number of extremely hot days (+32˚C) is expected to increase from an average of 1.2 days per year to an average of 8.3 days per year by 2050; and

    Whereas tenants living in units without air conditioning or other cooling equipment may be at higher risk of heat-related health impacts; and

    Whereas Kingston’s Community Heat Response Plan must go further to mitigate the effects of hot weather; 

    Therefore Be It Resolved That Council direct staff to bring forward an enhanced Community Heat Response Plan to the Environment, Infrastructure & Transportation Policies Committee by the end of Q1 2026 with recommendations and options including costing, and with consideration for an Inter-agency Extreme Weather Committee; and

    That this enhanced plan integrates innovative heat-mitigating infrastructure, such as shade sails etc., conducive to the needs of the community including vulnerable populations, tenants and people experiencing homelessness; and

    That this enhanced plan review and ensure the sufficiency and accessibility of cooling centres throughout the city; and

    That this enhanced plan encourages landlords to develop hot weather plans that designates an air-conditioned common room in their building as a cooling room; and

    That this enhanced plan works toward establishing a pilot outreach program where the City and its partners would support volunteers in going door-to-door in areas with vulnerable populations in partnership with City partners such as the South East Public Health Unit, Kingston Fire and Rescue, Frontenac Paramedics and potentially the Canadian Red Cross to check on residents, provide information on relevant services, and collect data to better assist the City in responding to extreme weather events; and

    That City staff work with agencies and community volunteers to improve the accuracy in determining the need for water during extreme heat events and ensure that need is meet; and

    That in meeting the need for water City staff work with partners and service agencies to assess the financial and operational feasibility to improve sustained and equitable access to safe drinking water in City parks, including evaluating options such as water stations, refill taps, and delivery support during extreme heat events.
